The plaintiffs demanded $8,000,000 before trial and sought nearly $6 million in actual damages from a Dallas County jury, plus additional damages for pain and suffering, disfigurement and punitive damages.
On April 20, 2008, Plaintiff Donna Baer, a veterinarian, was attending a seminar at the Marriott Renaissance Dallas. A cord cover had been temporarily placed over an expansion joint which was in the process of being repaired. Plaintiffs claimed the cord cover was not properly secured to the floor, and the expansion joint which it covered had been left in a state of disrepair. Dr. Baer claimed the cord cover caused her to fall, resulting in serious brain and orthopedic injuries.
Renaissance contended the cord cover was properly secured and was not an unreasonably dangerous condition. Jurors in Judge Mark Greenberg’s court in Dallas County agreed, and attributed no negligence or damages whatsoever to the hotel.
The case is Donna and Richard Baer v. Renaissance Hotel Management Company, LLC, No. CC-09-08780.

It will help first time buyers, as well as those who are looking to move up the ladder, by supporting the purchase of up to 3,000 new-build homes worth up to £250,000. Rather than making funding directly available to buyers, the Welsh Government and house builders will act as guarantors so that buyers can secure high loan to value mortgages which would not otherwise be available to them. Buyers will only be required to contribute a 5% deposit.
Richard Lane, Head of Commercial and Dominic Marshall, Head of Banking and Finance at Hugh James are the lead advisors on the scheme. Dominic Marshall said "We are really pleased to be involved in such an important project for Wales. Our Commercial Team and our specialist banking lawyers are working closely together to ensure that the Government's objectives are achieved."
Huw Lewis, Housing Regeneration and Heritage Minister, said: “This innovative scheme is excellent news for potential house buyers, the housing industry and the wider economy. “Not only will it help people whose plans for buying their first home or for moving to a bigger home have stalled due to lending restrictions from banks, but it will also provide house builders with potential new customers, and therefore will boost house building which will in turn create jobs and stimulate growth.” The scheme was announced by the Welsh Government on 13 November 2012 and is due to come into operation in the spring of 2013.

The business, which has been trading for ten years and is run by husband and wife, Hugh and Alex Pattison-Appleton, now has seven outlets in total, including two in Hereford, as well as branches in Leominster, Ledbury, Ross-on-Wye, Bromyard and Longtown.
Cartridge World is the leading supplier of printer cartridges in Herefordshire. Specialising in refilling all manner of cartridges, both ink and laser, with up to 60 per cent saving on the cost of originals, they also sell a wide range of original cartridges, printers, specialist papers and peripherals. Business services include free loan printers, printer servicing and independent advice on printing.
Alex said: "We are delighted to open our seventh store, and our second in Hereford, which provides our customers with a convenient city centre location, easy parking and a completely modern, refurbished, visually-stunning showroom. We are also delighted to have been able to offer further employment in the county via a new management position." The new store launched with a fan-fare last month, with local MP Jesse Norman officially opening the retail premises and overseeing the presentation of prizes to the winners of a competition run by Cartridge World to highlight their expansion. The next phase for the successful business is to move their existing Union Street premises into a dedicated production unit early in the New Year, and to close the now out-grown Union Street shop, transferring the bulk of their Hereford retail business to Bewell Street. Hugh Pattison-Appleton said: "Our ambition is to develop our production unit further, which should then allow for future expansion into Wales and Worcestershire."

The opportunity arises as a result of a recent First Tier Tribunal decision where HMRC’s long standing policy of only applying repayment supplements for input VAT reclaimed on VAT returns submitted on time has been called into question.  The Tribunal confirmed that all claims of input VAT including those made by voluntary disclosure can qualify for repayment supplement if they meet the relevant conditions to qualify.  This is an important decision as previously there was no sanction against HMRC for undue delay in processing and repaying a voluntary disclosure claim. 
Any taxpayers that have submitted voluntary disclosures where a delayed repayment of VAT has been made by HMRC could be entitled to apply for repayment supplement of 5% of the amount of VAT involved.  There are specific conditions attached that must be met, one of which is that HMRC must have taken more than 30 days (after all reasonable enquiries have been completed) to repay the VAT due.  This may be most relevant where there has been a dispute with HMRC that has been recently resolved or where HMRC have taken excessive time to conclude their enquiries. 
This is a case that may be subject to appeal and further litigation and it may therefore be some time before HMRC accept the decision and agree to any repayment supplement claims.
