Overview

Amyt Eckstein is a technology attorney and a member of the Entertainment, Intellectual Property, Internet/Technology and Advertising practice groups.   He represents domestic and international companies from a variety of sectors, including financial services, technology, Internet, telecommunications, media, healthcare and insurance.  Amyt provides guidance to clients in matters involving electronic commerce, intellectual property, privacy, as well as issues concerning emerging laws and regulations affecting the technology aspects of regulated and unregulated industries. 

Amyt advises on privacy, security and technology issues relating to financial services and healthcare services (HIPAA and HITECH compliance) transactions.  He advises companies offering products and services over the Internet and counsels clients on web site disclosures, security statements, contractual arrangements, advertising, privacy programs and policies.  He advises a broad spectrum of industries on the laws and regulations relating to privacy and compliance with respect to protected personal, financial, health information, data mining, and the ability to use such information for marketing purposes and share it with others.  Amyt prepares privacy policies and procedures for a wide variety of companies, and works with chief information, technology and privacy officers.  He provides advice related to payment mechanisms and the various laws and regulations applicable to electronic commerce.

He counsels clients in connection with content production and distribution as well as technology development and the licensing of online products and services.  Amyt negotiates technology transactions such as:

·         ASP (“the cloud”), hardware, wireless, license, collocation and App deals;

·         outsourcings which include BPO, ITO and HRO deals;

·         services deals, including development, professional service, marketing, distribution and consulting agreements; and

·         e-commerce matters such as social media, on-line presence, terms and conditions, privacy, web disclosures, and online assents. 

 

Amyt regularly advises clients on how to protect and license their intellectual property for use in all forms of media, and helps assess the risks associated with the exploitation of intellectual property on the Internet.  He advises on IT licensing, open-source software, intellectual property and computer law. 

Amyt represents both providers and users of outsourcing services.  Representative transactions and matters, include purchase, sale and lease agreements involving hardware and software assets; customer relationship management, marketing and call centers; facilities and project management; Medicare benefits eligibility determination, mail delivery and reprographics services and insurance claims processing; international privacy, data security, disaster recovery, alternative production facilities and business continuity (i.e., issues arising from the migration of processing and applications to a cloud computing platform).

In the international arena, Amyt is experienced in matters related to import and U.S. Customs, including classification, valuation, rules of origin, country of origin marking requirements, penalties, Customs-Trade Partnership Against Terrorism (C-TPAT) certification, anti-dumping and countervailing duty issues, foreign trade zones, duty preference programs (i.e., GSP, NAFTA ), drawback and import compliance reviews.

Amyt supports several charity organizations and advises on various charity-related issues including registration and commercial co-venture issues.
