Overview
Eric P. Bergner joined Moses & Singer after graduating from New York University School of Law in 1991, where he was elected to The Order of Barristers, a national honor society. He is a member of the Entertainment, Intellectual Property, Advertising and New Media Groups at Moses & Singer.
Mr. Bergner has strong transactional experience in the television and motion picture industries. He represents producers and distributors, including one of the largest independent producers and distributors of television programming in the United States, as well as cable television networks. He has assisted clients in selling and acquiring rights to formats, life stories, screenplays, music, and other properties for use in audiovisual works, and has drafted and negotiated talent and production agreements for various types of projects. Mr. Bergner also regularly deals with issues arising in connection with the distribution of programming, and has drafted and negotiated agreements for the sale and acquisition of program distribution rights, as well as agreements for domestic syndication. He has developed a particular experience in the arena of international distribution of television programming.
In addition, Mr. Bergner has a great deal of experience in the music, publishing and advertising industries, having drafted and negotiated record label agreements, book publishing agreements, agreements with illustrators, and media buying and planning agreements.
All of Mr. Bergner's transactional experience is supported by his strong intellectual property background. Mr. Bergner is a copyright and trademark counselor. He regularly advises clients in a number of industries on how to protect their intellectual property, and helps assess the risks associated with the unlicensed exploitation of the intellectual property of others. He has advised and assisted clients on intellectual property issues associated with conducting business on the Internet. Mr. Bergner also clears and registers trademarks, and is responsible for the domestic and inter- national trademark programs of a number of clients.
Mr. Bergner assisted in the preparation of friend-of-the-court briefs in Tasini v. New York Times Co. (a landmark new media case), and in the copyright case Broadcast Music, Inc. v. Edison Bros. Stores, Inc. (dealing with the right to publicly perform copyrighted music without a license), and participated in the recent case of Carell v. Shubert Organization, Inc., involving novel issues of copyright law arising out of the long-running Broadway musical Cats. He was also quoted at length in The Industry Standard and Interactive Week on the Napster litigation.
