Overview

In his work for intellectual property clients, Mr. Padden has successfully prosecuted and defended a variety of trade secret and patent infringement actions involving a variety of technologies. In the area of antitrust, Mr. Padden has tried cases involving claims of monopolization, attempts to monopolize, price discrimination, exclusive dealing, division of markets and restraints of trade. His experience also extends to a variety of commercial litigation matters such as breach of contract, breach of fiduciary duty, and other business tort claims.

His experience spans a broad range of industries, from healthcare and telecommunications to real estate development and beer distribution.

Mr. Padden has tried cases in state and federal courts throughout the country, as well as before numerous arbitration tribunals.

Representative matters:

Successfully prosecuted and defended patent infringement claims in a variety of settings, including mechanical patents, business method patents, and Hatch-Waxman litigation, acting as lead or co-lead trial counsel at trial
Defeated repeated actions to bar a proposed real estate development and established right of a developer to recover damages against a municipality that obtains an improvidently granted preliminary injunction
Obtained unprecedented preliminary injunction against quantity discount program in price discrimination action against major national brewer
Successfully defended major mining equipment manufacturer against multi-million dollar breach of warranty claim in international arbitration
Uncovered misappropriation of engineering drawings by client's former employee, leading to favorable settlement in litigation against competitor who hired the former employee
Defeated seven summary judgment motions and obtained summary judgment barring key defenses of laches and estoppel in pharmaceutical patent litigation, leading to settlement after two days of trial
Successfully defended major telecommunications equipment manufacturer against antitrust and state law claims arising out of dealer termination by removing action from state court and prevailing in preliminary injunction hearing in arbitration
